Gutiérrez Retamino's decision follows a conversation with Agüera, who expressed his intention to resume the position. The resignation will become effective at the next municipal plenary session, scheduled for Thursday, April 16.
Agüera's return is made possible by the provisional dismissal of the case against him, decreed on March 17 by the Instruction Court number 16 of Seville. The complaint, filed by Manuel Carbonell, failed to prove the commission of any alleged harassment of a minor.
Previously, the former mayor had resigned on February 23 and had been temporarily suspended from the PSOE party. After the precautionary measures were lifted, Agüera has recently rejoined his party.

In his statement, Gutiérrez Retamino emphasized that his decision prioritizes the general interest of the municipality and highlighted the "honor" of having represented La Algaba, thanking the support received during his tenure at the head of the City Council. The Sevillian town is thus preparing for a new change in its municipal leadership.
