The decision by the Port Authority of the Bay of Cadiz to reject the concessionaire's appeal for an extension until September, coupled with the formal notification from the El Puerto City Council regarding the termination of authorizations, has created significant uncertainty among owners and their staff.
Faced with this scenario, business owners plan to pursue legal action by requesting precautionary measures. They seek a judge's permission to continue operating normally until the end of the summer season, citing the substantial economic damage that closure during peak season would entail.
“"The decision exclusively responds to the application of current regulations and the exercise of the powers granted by law in the management of public port domain."
The Port Authority unanimously dismissed the appeal filed by the concessionaire Marina Puerto de Santa María S.A., which sought to maintain the activity of the 'demountable kiosks'. They stated their actions comply with regulations and do not preclude future hospitality developments in the area.
It is worth recalling that the Provincial Prosecutor's Office of Cadiz initiated a preliminary investigation into municipal licenses granted by the El Puerto City Council, filing a complaint with the Courts of First Instance for potential prevarication. The dispute centers on authorizations granted in March 2023, with limited validity and no music permits, which expired last March.
The concessionaire has initiated proceedings to modify the concession and pursue a new business model, but their request to continue current operations in the interim has been denied due to a lack of legal basis.
