The trial is scheduled for June 18 at the First Section of the Audiencia de Granada. The accused will face charges of threats, attempted homicide, and negligent injury, according to the indictment presented by the Prosecutor's Office.
The events date back to the afternoon of Christmas Eve 2022, when the defendant, accompanied by his wife, was unloading groceries from his car in front of his home. The vehicle was obstructing the passage, leading another driver, who was with his wife and baby, to ask him to move it.
The defendant's refusal and rude response sparked an argument. At one point during the dispute, the victim warned the accused, who, interpreting it as a threat, entered his house and returned with a 12-gauge shotgun, for which he had a license. He aimed at the vehicle where the victim was with his family.
Fearing for his safety, the victim quickly reversed his car. Subsequently, he got out to reprimand the accused's behavior. The argument drew the attention of several neighbors, including the victim's mother, whom the defendant directly threatened. The victim approached the entrance of the alleged aggressor's house, who supposedly took that moment to shoot him in the abdomen, hitting him in the side as he turned. The accused's wife was injured while trying to prevent the shot.
The Public Prosecutor's Office is seeking 17 months in prison for the crime of threats, in addition to a ban on communicating with and approaching the victim within 500 meters for four years. For attempted homicide, an additional seven years in prison, supervised release, and a ban on approaching and communicating with the victim for twelve years are requested. For negligent injuries to his wife, an additional five months in prison and deprivation of the right to possess weapons for three years are sought. Furthermore, the accused must compensate the main victim with ten thousand euros.
