The Sevilla Court found the officer guilty of a minor injury offense following an incident that took place on Economy Street, outside the Theatre Disco, between 5:30 and 6:00 AM. Police had been called to the scene after reports of a possible crime against sexual freedom.
Upon arrival, officers encountered a large crowd and a young man requiring medical assistance. While waiting for an ambulance, tensions escalated among those present, who began to confront the police, accusing them of inaction despite emergency services and additional police units being en route.
During the disturbance, a young man sat down in the middle of the street, posing a risk to himself and to traffic. The officer involved lifted him and moved him towards a police vehicle. The court noted that this was done forcefully, but without assault, as the man was refusing to cooperate.
The officer positioned the young man against the vehicle to conduct a search, but the man resisted by turning away. At that point, the situation escalated: the officer, standing behind him, lifted him slightly by the armpits and then threw him to the ground, leaving him on his back. He then slapped him on the right side of his neck and jaw.
The footage clearly showed that the injuries suffered by the young man were caused by the slap, and this was the only proven act of aggression during the encounter.
Even after this, the young man continued to resist, making it difficult for the officer to perform his duties. The incident was witnessed by several people and recorded on video, which was presented in court. All officers involved agreed that the young man showed "clear signs of intoxication," corroborated by a friend who testified about alcohol consumption before and during their time at the nightclub.
While the court acknowledged that the officer believed he was dealing with a "hostile situation" and that the detention itself was not illegal (the young man was later acquitted of resisting arrest due to lack of evidence), the slap was deemed unnecessary and resulted in a minor injury offense. Consequently, the officer has been handed a financial penalty and ordered to compensate the victim.
