JEA Dismisses PSOE-A Complaint Against Canal Sur Over 'Masks Case'

The Andalusian Electoral Board (JEA) has dismissed a complaint from the PSOE-A against Canal Sur, accused of omitting information on the 'Masks Case' and former minister Cristóbal Montoro, according to an agreement from April 5.

The Andalusian Electoral Board (JEA) has rejected a complaint filed by the PSOE-A against Radio Televisión de Andalucía (RTVA) and Canal Sur Televisión. The accusation centered on an alleged "violation of the principles of neutrality, objectivity, truthfulness, and informational pluralism during an electoral period" due to the supposed omission of details regarding the judicial summons of individuals investigated in the 'Masks Case', including the former provincial president of the PP of Almería, Javier Aureliano García.
The JEA's agreement, dated last Sunday, April 5, and consulted this Monday by Europa Press, also addressed the PSOE-A's complaint about the lack of coverage regarding judicial proceedings related to former Finance Minister, Cristóbal Montoro. The socialist party considered this omission to be a violation of Article 66 of Organic Law 5/1985, of June 19, on the General Electoral Regime (Loreg) and the principles of pluralism and informational neutrality.

To dismiss this complaint from the PSOE-A, the Andalusian Electoral Board focuses "on the principle of neutrality," understanding that it is the one "that could be specifically affected by the reported event.

The JEA based its decision on the "repeated doctrine established by the Central Electoral Board," which requires evaluating the lack of neutrality over a "broad space or time period," without being limited to an "isolated day or a specific news program." In this case, the PSOE-A's complaint specifically referred to the omission of information by Canal Sur on March 30, 2026, a period deemed insufficient to determine a violation of neutrality.
Furthermore, the Andalusian Electoral Board highlighted that the 'Masks Case' was indeed covered by the regional channel's news services on March 31, 2026, in programs such as 'Noticias 1', 'Noticias 2', and in the territorial disconnection in Almería, including critical statements from the opposition.
Finally, the JEA concluded that the PSOE-A's complaint "seems to have the predominant purpose of expressing the party's disagreement" with Canal Sur's editorial line, which, although legitimate, does not justify the claim. The RTVA has positively assessed this agreement, reaffirming its commitment to comply with the Loreg and provide an essential public service.
