The Electoral Board of Andalucía has dismissed the complaint filed by the PSOE-A against Canal Sur Televisión, concluding that the public channel did not violate informational neutrality in its coverage of the 'Masks Case' involving the Diputación de Almería.

The resolution from the Electoral Board of Andalucía (JEA) was made public following communication from the Socialist Party, which had filed about twenty complaints that were admitted for processing by the relevant electoral bodies. The specific complaint against Canal Sur, submitted on April 1, accused the public television of withholding information about a judicial investigation, thereby electorally favoring the Popular Party during the pre-campaign period.
However, the JEA determined that Canal Sur did cover the case on March 31, 2025, in its programs Noticias 1, Noticias 2, and in the territorial broadcast for Almería, as well as on its social media platforms. The electoral body also highlighted that the information provided included critical statements from María Márquez, deputy general secretary of the PSOE-A, who commented on the progress of the judicial investigation in question.

The function of the Electoral Board cannot become a kind of censoring entity that resolves discrepancies of criteria regarding the importance or relevance of the information that should appear in news program schedules.

In its agreement, the JEA reiterated that no political party has the right for a media outlet's editorial line to conform to its particular viewpoints. For its part, Canal Sur Televisión has reaffirmed its commitment to continue complying with the requirements of the Organic Law of the General Electoral Regime in all its news programs.
