The controversy has emerged following a public complaint by a renowned Sevillian artist, who stated that the Icónica Sevilla Fest has utilized her design, originally created for the 2017 Spring Festival, without seeking her consent. The artist also criticized the use of artificial intelligence in the event's advertising, advocating for the talent of professionals in the field.
“"Have they asked permission to use that idea from the #FiestasdePrimavera2017 poster? Not from me. And it's a shame they use AI when there are such great professionals in the world of communication and advertising. Things must be done properly."
The exploitation rights for the original poster belong to the Seville City Council, the entity that commissioned the artwork. If the Icónica Sevilla Fest does not have municipal authorization for its use, it could be infringing upon Intellectual Property Law. To date, neither the festival nor the city council has issued official statements on the matter, leaving the confirmation of such authorization unclear.
The festival, a private music event held in the iconic Plaza de España, reportedly used the design on its social media platforms and in various promotional materials. The use of an official Spring Festival poster without proper permission could be considered an act of unfair competition, with potential legal consequences.
