The Association of Matalascañas Owners has received official confirmation from the Andalusia Regional Government, dated May 27, 2026, regarding the illegality of the decree that ordered the start of the Parking Regulation Zone (ORA) service in the town. The Territorial Delegation in Huelva initiated legality oversight proceedings following a complaint from the Association.
The Andalusia Regional Government formally requested the annulment of the Almonte mayor's decree, declaring it illegal because it was issued by the mayor instead of the City Council's Plenary, as stipulated by the Local Treasury Law. The Association emphasizes that this confirms their initial claims about the decree's illegality.
The Regional Government's document reveals that the mayor issued a second decree on May 14, 2026, annulling the previous one. The Association criticizes that this annulment, which implies an implicit acknowledgment of illegality, was done silently, without informing the public, opposition council members, or the Association itself, until the official communication from the Regional Government was received.
The Association categorically refutes the governing team's claims of alleged endorsement from the Andalusia Regional Administrative Court for Contractual Appeals (TARCJA) for the blue zone. They explain that TARCJA dismissed the Association's appeal on procedural grounds, without ruling on the legality of the contract or service, labeling the dissemination of contrary information as "intolerable manipulation of institutional information."
The deliberate concealment of the decree's annulment during the municipal plenary sessions of May 15 and 21, while false information about judicial backing was being spread, is denounced. The Association believes these actions may contravene the principles of transparency and good faith governing public administrations.
Currently, the ORA service in Matalascañas lacks legal backing, as the initial decree was annulled and the necessary ordinances have not been approved by the Plenary, which has rejected them twice. The Association has informed the Huelva Prosecutor's Office and the Andalusia Regional Government of these events and assures it will pursue legal actions to restore legality.
