The incident took place in the hamlet of Zalea, within the municipality of Pizarra, around 9:00 PM last Monday. A call to Emergencias 112 reported a man wounded by a firearm. The 35-year-old victim was transported to a hospital in the provincial capital, and the Guardia Civil has taken charge of the investigation, with no arrests made so far.
The trial by popular jury, which was scheduled to start on Monday, was initially postponed due to a medical emergency involving one of the defendants. The assault suffered by one of the accused has now led to the definitive suspension of the oral hearing, which was meant to constitute the tribunal and hear from witnesses and defendants.
“"With the intention of ending both their lives, one of the defendants allegedly shot one of the victims with a short-barreled revolver in the chest, with the bullet entering below the collarbone and exiting through the back, causing his death."
The murder for which the three men were to be tried dates back to November 2019. According to the prosecutor's indictment, which seeks 37 years in prison for each, two of the accused took the two victims to a residence in Marbella. There, one of them fatally shot one victim, while another accused wounded the second man with a similar weapon multiple times, causing injuries that required a lengthy 336-day treatment.
The prosecutor detailed that the third accused had previously met with the other two to plan the crime, and that all three met again after the events. The public prosecution charges all three with murder (one in attempted degree) and belonging to a criminal group with possession of weapons. Additionally, two of them are also accused of illegal possession of weapons, as neither had a firearms license.
In addition to the prison sentences, the Prosecutor's Office proposes compensation of 200,000 euros for the heirs of the deceased and 26,280 euros for injuries and 99,000 euros for sequelae for the injured party.
