Floor Clauses: The Banking Scandal That Affected Thousands of Mortgages in Spain

The floor clause scandal in Spain, which impacted thousands of mortgages between 2002 and 2012, revealed how a lack of transparency in banking contracts led to significant overpayments for homeowners, especially expatriates.

For years, Spanish banking institutions included a clause, known as the 'floor clause,' in mortgage contracts that limited the reduction of interest rates. This practice, often poorly explained, prevented millions of mortgage holders from benefiting from falling interest rates after the financial crisis, keeping their monthly payments high.
The clause, which set a minimum rate of between 3% and 3.5%, was not properly disclosed to customers, leading to consistent overpayments. Many homebuyers, particularly between 2002 and 2012, found themselves trapped in unfavorable agreements, signing contracts in a foreign language without understanding the implications of this fine print.

"Between 2010 and 2021, I was paying 3.8% interest when I should have been paying around 1.5%. My monthly payment stayed at €875 for 11 years – it should have been closer to €640. I always felt something wasn’t right."

The situation dramatically changed in 2016 when the European Court of Justice ruled that banks must refund all money unfairly charged under non-transparent floor clauses. This decision forced institutions to repay billions of euros and ended a practice that had been defended as standard.
To claim a refund, legal experts point to three key conditions: the mortgage must have been taken out between 2002 and 2012, the contract must have included a floor clause, and a lack of transparency and overpayment must be proven. Institutions such as Solbank, Banco Sabadell, Banco Popular, Unicaja, El Monte, Cajaduero, Caja España, and Cajasur are among those affected.
Although banks have set aside around 200 million euros to cover claims, the reputational damage has been considerable. Trust in the banking system has been severely shaken, and many critics argue that the impact extends beyond financial losses, including years of financial strain and lost opportunities for those affected.
