The incident occurred at 02:00 AM on October 17, 2024, when the two assailants approached a property with the intention of stealing valuables. Unable to enter through the main door, one of them scaled the facade and entered through a window, while the other remained on the street as a lookout.
Officers from the National Police quickly arrived at the scene and apprehended the man waiting outside. Visibly nervous, he offered "contradictory and incoherent explanations" for his presence and denied anyone else was inside the house. However, officers searched the property and found the second accomplice "crouching in a small shed on the rooftop," thus thwarting the robbery.
“"There is no reason to doubt their guilt, and an accused cannot be exonerated merely by claiming they were retrieving tools from a property not their own."
After being convicted in June 2025 by the Criminal Court No. 2 of Almería for attempted aggravated robbery, one of the individuals appealed the decision. He insisted it was a misunderstanding and that he had only gone to the house in the early hours to retrieve tools he had left behind after making repairs days earlier.
The Provincial Court has rejected this alibi, supporting the initial judge's assessment. The court stated that there are no doubts about the defendants' guilt, who must now serve their prison sentences and jointly pay 115.70 euros for the damages caused to the property.
