Initially scheduled for May, the judicial process will now take place on September 22, 23, and 24. This change, according to sources close to the case, might not be the last, as the new date requires the consensus of all parties involved, including the seven defense lawyers.
Unlike other parts of the Marchelo case, where agreements were reached to avoid trial, this time it was not possible. The private prosecution, brought by a businessman, seeks prison sentences for the accused and compensation for damages and losses resulting from the allegedly illicit construction of the gas station on Avenida de Andalucía in the municipality.
Among the accused are a former councilor for Urban Planning of Alhendín, two other former councilors who were part of the governing commission, a municipal architect, and the businessman who was granted the license. The Prosecutor's Office requests 18 months in prison for the three former councilors and the municipal technician, and 21 months for the implicated businessman, as well as for the former mayor, whose case was provisionally shelved due to health reasons.

The alleged crimes, dating back to 2002, include influence peddling, urban planning malfeasance, and administrative malfeasance. The Prosecutor's Office maintains that the operation involved a fraudulent change in land classification to allow the construction and commercial exploitation of the gas station, despite the activity being incompatible with current urban planning regulations.
