Legislative Advance Against Vicarious Violence with Support for Minors

The Government, from Maracena, is promoting a reform that allows minor victims of violence to access help with the authorization of a single parent.

The Government has presented in Maracena, Granada, a draft law aimed at strengthening child protection against vicarious violence, removing barriers for minors to access support services with the authorization of a single parent.

The expansion of the Comprehensive Protection Law for Children and Adolescents against Violence (LOPIVI) will enable minors affected by violence to access essential services such as psychological care, social support, or legal advice. This measure can be implemented with the authorization of a single parent, as highlighted by the Minister of Youth and Childhood, Sira Rego.
During the inauguration of the V State Meeting on Vicarious Violence and Institutional Gender Violence in Spain, held in Maracena, Minister Rego celebrated the approval of this draft law, describing it as a step that "shields rights" and considers children and adolescents as "subjects of rights and not extensions of adults".
The legal reform is structured around three fundamental pillars. Firstly, it guarantees the right of minors to be heard, eliminating the age limit of 12 years and the consideration of "sufficient maturity". Secondly, it explicitly and unequivocally prohibits the so-called Parental Alienation Syndrome (SAP). Finally, it establishes that the protection of minors can never imply cohabitation with the abuser.

The Minister of Equality, Ana Redondo, has called for institutional, political, and social unity to combat vicarious violence and advance the legislative reforms proposed by the Government. Redondo stated that Spain will be the first country to criminalize vicarious violence in its penal code, representing a "qualitative leap" in the comprehensive protection of victims. She also emphasized the need to address institutional violence.
The management of the Maracena Women's Center and co-organizer of the meeting described the reform of the child protection law as "ambitious" and "brave," although they insisted on the need for a "radical change" in the justice system for its effective implementation.
