The defendant in the crime, which took place on January 16, 2024, explained during the popular jury trial at the Audiencia de Granada that both families have been in conflict "for some time." According to his testimony, he acted driven by "atrocious fear" of suffering the same fate as his brother, who has been missing since July 2023.
The Prosecution maintains that the accused traveled to the victim's location in the small square of the old football field in Atarfe to execute him at close range while he was talking to a neighbor. The Public Prosecutor's Office is seeking 31 and a half years in prison, in addition to charging him with psychological injury to the three-year-old daughter who allegedly witnessed the event.

The accused, who testified in tears, has denied the presence of the minor in the vehicle and stated that it was the victim who pointed a weapon at him first. He added that he always carried a weapon due to previous disputes between the clans, during which his mother was also the target of an attempted hit-and-run.
The private prosecution, representing the victim's family, is seeking 33 years in prison for murder, illegal possession of weapons, and psychological injury. They emphasized that the victim had no opportunity to defend himself and that the crime "destroyed a childhood" by being witnessed by the three-year-old daughter.
The defense, on the other hand, has withdrawn the mitigating factor of drug addiction and classifies the acts as homicide, requesting five years in prison, plus one year for illegal possession of weapons, applying mitigating factors for confession and insurmountable fear. They recalled that the accused voluntarily presented himself at the Guardia Civil barracks in Atarfe to confess and hand over the weapon.
