The agreement between the European Union and the United Kingdom concerning Gibraltar is in its final stages, with provisional application scheduled for July 15. This pact, concluding nearly five years of negotiations, will dismantle the physical border and introduce a new mobility framework between the territory and the Schengen area.
The treaty's implementation hinges on its signature by Brussels and London, though a specific date has yet to be set. Following this, the ratification process by European institutions and the United Kingdom will commence to ensure its full validity.
This political agreement, announced on June 11, 2025, comes a decade after the Brexit referendum. The definitive legal text was finalized in December 2025 and publicly released in February 2026, comprising over a thousand pages.
After legal review, the document will be formally adopted by the Council of the European Union before its signature. Spain played a significant role throughout the negotiations as part of the EU's team.
The July 15 date signifies a major change with the removal of the border separating Gibraltar from La Línea de la Concepción. Controls will be relocated to Gibraltar Airport, where the Spanish National Police will manage Schengen entry checks.
Initially planned for April 10, the delay was attributed to technical complexities and its overlap with the launch of the European Entry/Exit System (EES). Spain and Gibraltar are finalizing preparations, as coordinated in a meeting between the Minister of Foreign Affairs, José Manuel Albares, and Gibraltar's Chief Minister, Fabian Picardo, in Madrid.
Despite provisional application in July, the agreement still requires final ratification by the European Parliament and the Council, as well as by the Parliament of Gibraltar and Westminster in the United Kingdom.
The British Government will present the text to the House of Commons, where it is expected to pass smoothly given the Labour majority. British legislation allows a 21-day parliamentary session for approval.
This agreement, initiated in 2021, marks the end of a historic physical border and the beginning of a new relationship between Gibraltar and the European Union in the post-Brexit era.
