The discussions focus on Law 5/2025, of December 16, on Housing in Andalusia, which was approved by the Andalusian Parliament on December 2, 2025, with the sole support of the PP-A and the rejection of Vox, PSOE-A, Por Andalucía, and Adelante Andalucía. The central Executive deems several points of this regulation unconstitutional.
The agreement to commence these negotiations was recorded on March 23 by the Subcommittee for Regulatory Monitoring, Prevention, and Resolution of Disputes of the Bilateral Cooperation Commission between the General State Administration and the Autonomous Community of Andalusia. This pact was published this Monday in the Official State Gazette (BOE) and the Official Gazette of the Junta de Andalucía (BOJA).
Among the disputed articles are 4, 13, 14, 24, 31, 40, 49, 50, 51, 52, 63, 64, 66, 89, 90, and 96. The disagreements range from definitions of housing and its typology to public-private collaboration mechanisms for protected housing construction, compatible uses in public community equipment land, and aspects related to the Building Book and the Housing User Manual.
Also under discussion are redistribution and improvement works in residential buildings, the regulation of specialized real estate agents, and the management of the public housing stock. The third final provision, which modifies the Andalusian Protected Housing Regulation (approved by Decree 149/2006, of July 25), is also a point of contention, particularly regarding the selection procedure for beneficiaries and the provisional qualification of housing.
