The High Court of Justice of Andalusia (TSJA) has issued an order formally requiring the Carboneras Town Hall to proceed, within a maximum and non-extendable period of 20 working days, with the annulment of the construction license for the illegal hotel located in the Cabo de Gata Natural Park. This requirement is directed at the town's mayor, Salvador Hernández, demanding that the council conclude the review process of the license granted in January 2003 to the entity Azata del Sol S.L.
In case of non-compliance, the TSJA warns that it may order the subsidiary execution of the sentence, which would mean the court taking over municipal responsibilities to invalidate the construction license through its own legal means. This resolution comes after the postponement of a key vote in the municipal plenary on June 17, which was intended to unblock the situation for the demolition of the establishment.
The Carboneras Town Hall has repeatedly failed to comply with the TSJA ruling since 2021, which became final in December 2022. The hotel, with 411 rooms and 20 floors, is situated just 14 meters from the seashore. The municipal plenary's decision on June 17, which was to vote on the review of the license, was blocked by a motion presented by former mayor Felipe Cayuela and supported by PSOE councilors, requesting additional reports on the patrimonial and urbanistic impact of the nullification.
As a consequence of this blockage, a joint Government-Junta de Andalucía commission was convened. Both administrations agreed on the objective that the hotel should be demolished. The expropriation route, proposed by the central government, is now subject to the TSJA's decision on the license annulment.
