Former Granada Councillor Disqualified Over TG7 Irregularities

The Audiencia de Granada has sentenced Juan Antonio Fuentes to nine years of disqualification for administrative malfeasance in contracting services for the municipal television station.

The Audiencia de Granada has ruled to disqualify Juan Antonio Fuentes, a former councillor for the Popular Party, for nine years, after finding him guilty of administrative malfeasance in managing contracts for the municipal television channel, TG7.

The sentence, accessed by Europa Press and subject to appeal, declares the nullity of the complementary services agreement signed in July 2015, as well as the debt settlement records linked to that document. This ruling follows a judicial process that examined irregularities in the contracting of extraordinary services for the local broadcaster.
The Second Section of the Audiencia determined that Fuentes, in his role as councillor at the time, lacked the necessary authority to sign the 2015 agreement. Furthermore, the procedure used did not comply with the general regulations of the Public Sector Contracts Law. Reports presented and testimonies from the general secretary, municipal comptroller, and head of the City Council's Legal Advisory Office during the trial confirmed the absence of budgetary allocation, legal reports, and proper intervention in the contract.

There was no budgetary allocation to cover the payment of invoices associated with the agreement, nor a legal report or intervention in the contract.

The court emphasized that the controversial 2015 agreement was not a mere appendix to the initial 2011 contract, but a substantial modification. This alteration involved changes in the contracting parties and, more importantly for the court, established “significant obligations on the part of the City Council” related to the execution of the original contract. The agreement acknowledged the provision of numerous extraordinary services that were to be paid for by the council, despite the parties having devised a sponsorship formula to cover the debt.
The sentence downplays whether the complementary services were actually provided between 2013 and June 2015. Instead, it highlights that the crucial point is that the agreement created financial obligations for the City Council, having been signed by an individual without the authority to contract, outside the established procedure, and without proper expenditure oversight.
It is worth noting that, although the Provincial Court had acquitted Fuentes in November 2023, the High Court of Justice of Andalusia (TSJA) accepted an appeal from the Prosecutor's Office, annulling the trial and the subsequent acquittal. This led to the facts being re-tried by a different court last February. The Prosecutor's Office had requested 15 years of disqualification and estimated the financial damage to municipal coffers at 864,121 euros. During the first session of the trial, Fuentes defended the agreement as “good for the city,” arguing that it reduced the municipal television's debt by approximately 300,000 euros and that he did not participate in its drafting or legal clauses.
