In addition to the fines, 306,942 euros have been deducted from monthly invoices for services not rendered or for Quality Plan penalties between January and August. Two of the seven opened proceedings are classified as very serious, including the repeated failure to provide scheduled ordinary services and non-compliance with the implementation of services and facilities committed in the contract.
The Councilor for Street Cleaning, Eloy Belmonte, explained that control is daily and based on an exhaustive record of services provided. "We do not act on impressions here: we act on a daily record, service by service, with the documentation in front of us," he stated.
Of the 306,942 euros deducted, 286,718 euros correspond to services not performed (169,133 for waste collection and 117,586 for street cleaning), and 20,224 euros for Quality Plan penalties. The months of July and August account for 43% of the total deducted this year.
The 6 million euro fine for non-compliance with implementation obligations, imposed in May, is still in process pending execution. The proceedings attribute to the contractor the repeated failure to provide services, non-compliance with obligations, and omission of the duty to report vehicle breakdowns.
Belmonte emphasized that FCC is a leading multinational and that its breaches are "difficult to explain." He recalled that the contract, awarded in 2022, includes an automatic annual price review, but the department focuses on ensuring service compliance and sanctioning failures.
The councilor warned that three very serious breaches could lead to contract termination. "It is not in our power to change what others signed; what is in our power is to ensure it is fulfilled: to check every service, not to pay for what is not provided, and to sanction what is not complied with," he concluded.
