The conviction, confirmed by the TSJA, is for the accused's active participation in three home invasions, despite him only admitting to one. The court dismissed the appeal filed by the defense, validating the evidence linking him to the incidents.
The robberies occurred in November 2018. The convicted individual traveled to Córdoba with at least two other people who are currently at large. The group stayed in a hostel to gather information on areas favorable for committing robberies, specifically targeting homes with easy access to city exit highways to ensure a quick escape.
They typically operated in the morning, taking advantage of owners being at work and homes being empty. To gain access, they used the technique of fracturing the lock cylinder. The most significant robbery took place on November 8, 2018, when the convicted man and his accomplices forced entry into two homes in the same building. From one, they stole a bolted safe containing jewelry valued at over 60,000 euros and an envelope with 40,000 euros in cash, plus other items, totaling 146,582 euros.
In the second home, located in the same building and assaulted within the same timeframe, they took three watches, diamond jewelry, laptops, and various clothing items, valued at 5,645 euros. Weeks later, on November 27, the accused participated in a third robbery on a different street in Córdoba, where the loot included watches, jewelry, and a handbag.
The court considered it “implausible” that the accused would rob one apartment and, on the same morning and in the same building entrance, a different gang would rob the apartment upstairs using the exact same lock-breaking method.
The Third Section of the Provincial Court of Córdoba initially imposed the six-year prison sentence. The TSJA has upheld the Provincial Court's reasoning, based on “strong circumstantial evidence,” and confirmed the aggravating factor of belonging to a criminal group, finding it proven that the accused and his companions traveled to Córdoba specifically to commit crimes and planned the robberies in a coordinated manner.
