The court fully rejected the appeal filed by the officer, who was seeking financial compensation. The judicial decision emphasizes that the annulment of an administrative sanction does not automatically imply the right to compensation from the State.
The conflict originated in June 2017, when the Civil Guard member was sanctioned with an eight-day suspension of duties. The sanction was based on an alleged serious breach of “professional secrecy,” accusing him of having disclosed details of an anti-drug operation to the media.
The officer, who was acting as a representative of the Unified Association of Civil Guards (AUGC), later had the sanction annulled. However, the National Court has ruled that this annulment is not sufficient grounds to grant the requested compensation.
