The First Section of the Contentious-Administrative Chamber of the High Court of Justice of Andalusia (TSJA) has issued an unfavorable ruling for a resident of Córdoba who is in a situation of special vulnerability. The court has dismissed the appeal filed by the man, who has a recognized disability of 69% and a severe dependency level II.
The plaintiff was claiming from the Junta de Andalucía the payment of a rental subsidy, which had previously been denied due to a lack of budgetary credit. As a consequence of the judicial decision, in addition to not receiving the aid, he has been ordered to pay the legal costs, the maximum amount of which could reach 1,000 euros.
The case dates back to the 2018 rental aid call for applications, aimed at individuals with limited incomes and young people. The appellant, given his condition of severe dependency, was requesting a subsidy covering 75% of his monthly rent (valued at 300 euros) for a period of 36 months, totaling a claimed amount of 8,100 euros.
