The Court of Málaga has sentenced José J.M., known as 'Dinamita Montilla', to 24 and a half years in prison for the murder of a young man in Los Montes de Málaga in 2022, after which he stole his belongings.

The sentence, issued after a guilty verdict by a popular jury, establishes that on August 29, 2022, the victim was collecting carob pods in an area of Los Montes when he encountered the accused. Following a brief conversation, the young man headed to a nearby farm, where he was surprised by the accused, who had followed him.
According to the ruling, the accused, carrying a shotgun, ensured the young man's solitary and defenseless situation and, with the intent to end his life, unexpectedly shot him in the neck. Subsequently, as the victim fell to the ground, he shot him again in the head, causing his death.
After the double shooting, the convicted man accessed the victim's backpack, opened it, and took valuable belongings before fleeing the scene. To commit the crime, he used a shotgun loaded with two semi-metallic cartridges, lacking a license to carry a firearm.
The sentence includes 20 years for a murder offense with the aggravating factor of recidivism, along with a prohibition from residing in or visiting the victim's family's municipalities for 30 years. He also received one year in prison for illegal possession of weapons and three years and six months for robbery with violence.
In terms of civil liability, the accused must compensate the victim's parents with 76,790 euros each for moral damages and an additional 25,000 euros each for exceptional damages, as well as for the items stolen from the victim.
Key evidence for the conviction included police and DNA reports, which identified the accused through a sample found on the victim's backpack. The jury found it proven that the accused took advantage of the victim's solitary and defenseless situation to commit the crime, repeating patterns from his previous convictions.
