The Municipal Delegation of Urban Planning carried out a total of 15 halting and sealing actions on rural land in the first six months of the year, aiming to prevent illegalities and restore urban planning legality. These interventions were dispersed across various areas, including El Marquesado, Pinar de los Franceses, Majadillas, Los Llanos, Pago del Humo, Carboneros, and Pago Melilla.
The total area affected by these halts and seals exceeds 99,000 square meters, spread across more than 100 plots with varying degrees of construction. Three large subdivisions stand out: one in Dehesa de la Raya exceeding 18,000 m², another in Pago Melilla of approximately 15,000 m², and a third in El Marquesado with over 10,000 m². In contrast, the Carboneros area features smaller plots, not reaching 500 m².
Additionally, the Delegation has issued 26 final demolition orders for different properties, including three cases of housing extensions on urban land within a real estate complex in Novo Sancti Petri. These figures represent a significant increase compared to the previous year, when 15 operations were halted across 6.5 hectares and 23 legality restoration orders were issued.
In the criminal sphere, 22 reports were sent to the Public Prosecutor's Office for alleged crimes against Territorial Planning. A recent ruling, number 109/2026 from the Criminal Division of the Court of Instance of Cádiz, sentenced two individuals to prison terms, fines, and disqualification, in addition to ordering the demolition of several buildings and enclosures.
The Urban Planning Delegation reminds the public that installing prefabricated constructions, even without traditional groundwork, constitutes the same illegality as brick or concrete block constructions. Furthermore, it clarifies that the classification of land as urban or rural falls under the Law for the Promotion of Territorial Sustainability of Andalusia (LISTA), and that any mention of 'urban' in notary deeds is irrelevant for urban planning purposes.
