Both defendants face a prosecution request of two years in prison for negligent injury, while the victim's private prosecution has raised the demand to three years. A third defendant, another employee, had charges dropped by the prosecution after his testimony.
During the trial at the Criminal Court 5 of Granada, the victim recounted how she repeatedly warned about the strong gasoline smell of the mixture. Despite her warnings, one of the individuals lit a lighter, causing the victim to catch fire as she could not extinguish the flame.
The woman, who suffered severe burns and required ICU admission, described how she tried to put out the flames by removing her t-shirt and how a friend shouted at her to roll. It was one of the accused who eventually sprayed her with a fire extinguisher and took her outside, where water further worsened her injuries.
The involved employee stated he was returning from vacation and used the pre-prepared mixture without considering any potential mistakes, while the owner claimed the formula had been used about 500 times without incident, suggesting an error in its preparation.
“"We used that formula about 500 times and nothing ever happened, so someone must have made a mistake with the mixture."
The initial claim of nearly two million euros by the prosecution and private prosecution to compensate the victim for her physical and psychological sequelae is now being processed in a civil procedure to expedite the criminal case.
The incident occurred during a game in the house's kitchen, where participants were locked in. In another room, two actors, one of them an accused, instructed the victim to get on a chair, where she was tied by the hands and had a rope placed around her neck. She freed herself but remained in the same position to avoid detection. Subsequently, one of them allegedly poured a liquid from a drum and set her on fire despite her warnings about the gasoline smell.
