The initial approval was agreed upon by the Plenary Session of the Hornachuelos City Council during an ordinary session held on September 30, 2026. Following this decision, a one-month period is now open for interested parties to submit any relevant objections.
The main objective of the new regulation is to establish the rules governing the use of municipal sports facilities, including both spaces specifically designated for sports practice and their complementary areas, such as changing rooms or stands. A sports facility is defined as any space intended for physical activity.
The text classifies municipal sports facilities as public domain assets dedicated to the provision of a public sports service. The regulation will apply to all municipally owned facilities, regardless of their management model, whether direct or through concessions to clubs, associations, or private companies.
Various usage modalities are contemplated, including occasional, collective, seasonal, and annual uses. Alternative sports uses and, in certain cases, non-sports uses compatible with the facility's characteristics are also permitted. Extraordinary uses will require express authorization, and non-compliance with conditions may lead to the cancellation of concessions.
Facility usage can be arranged through municipal programs, agreements with other entities, or through corresponding concessions and usage authorizations, which can be established by year, school year, season, specific period, match, or event. In cases of conflicting requests, priority will be given to sports activities over non-sports activities, more important events, and earlier submissions.
Ordinary reservations require a specific application, and cancellations must be communicated at least 48 hours in advance to avoid full payment of the reservation. For periodic uses exceeding ordinary daily use, a prior written reservation will be necessary. Failure to use or non-payment may result in the loss of usage concession rights for up to two years.
Users' obligations include the proper use of spaces and equipment, respect for established schedules, staff, and other users, as well as payment of applicable fees. Damages caused by negligent or improper use may be claimed from those responsible, including parents or legal guardians for minors. Appropriate sports attire and footwear are required.
Smoking, consumption of alcohol and drugs, and the entry of animals (except guide dogs) are expressly prohibited. Playing with balls in changing rooms, corridors, or stands is also not permitted. Users have the right to respectful treatment, to enjoy services under established conditions, and to submit complaints and suggestions.
The regulation guarantees that facilities will be open to all individuals without discrimination. The City Council will maintain civil liability insurance for directly managed facilities, and emergency, evacuation, and fire protection plans will be required. Those responsible for extraordinary uses must have specific insurance coverage.
A specific section is dedicated to the municipal swimming pool, prohibiting glass objects, spitting, running, or discarding waste, and requiring showering before use. Access will be denied to individuals with certain infectious diseases or open wounds, and during the last 30 minutes of public swimming hours.
In the pavilion, coaches and team leaders will ensure compliance with the rules. Monitors must be adults, and written applications are required for certain uses. Specific times are set for access to and exit from changing rooms, particularly for official matches.
The sanctioning regime classifies infractions as minor, serious, or very serious, with consequences ranging from written warnings to the loss of user status for extended periods. Mitigating circumstances are considered, along with a hearing process for those facing sanctions.
Usage fees, as approved by fiscal ordinance, will be mandatory for users, barring exemptions. The regulation also addresses the conservation and maintenance of facilities, with the Sports Department responsible for maintaining an updated inventory of sports equipment.
