Vaping at the Feria de Abril: What does the law say about its use in Seville's casetas?

The rise of electronic cigarettes has sparked questions about their use in crowded venues like the Feria de Abril de Sevilla casetas, where legislation draws clear distinctions from traditional tobacco.

In recent years, electronic cigarettes, commonly known as vapers, have seen a significant increase in popularity, particularly among young people and adults. These devices, which operate by heating a liquid that may contain nicotine to produce vapor, have gained traction due to the perception that they are less harmful than conventional tobacco and the possibility of using them in places where smoking is restricted. However, their indoor consumption continues to be a subject of controversy, especially in environments with high concentrations of people.
One such scenario is the Feria de Abril de Sevilla, an event that gathers thousands of people in its casetas—many of which are small—for hours. In these enclosed spaces, the sight of attendees using vapers has become common, raising questions about whether this practice is permitted or regulated.
Current Spanish legislation establishes clear differences between tobacco consumption and the use of vaping devices. Law 28/2005, of December 26, which regulates health measures against smoking, prohibits smoking tobacco in enclosed public spaces, such as bars, restaurants, and other hospitality establishments, allowing it only on terraces or in open-air areas.
However, the legal treatment of vaping devices is different. Their regulation is not found in the main articles of the law, but in the Twelfth Additional Provision, which lists specific places where their use is prohibited. This provision states that the consumption of nicotine-releasing devices, such as electronic cigarettes, is not allowed in centers and dependencies of Public Administrations, health centers (including their outdoor areas), educational and training centers (with exceptions for outdoor spaces in universities and adult education centers), public transport, and children's playgrounds.
Outside these specific cases, the law does not establish a general prohibition on vaping in private public-use spaces, which allows for different interpretations in concrete situations. This regulatory framework is crucial for understanding the situation at the Feria de Abril de Sevilla, where both public and private casetas coexist. In public casetas, which are equated to administrative spaces, vaping is prohibited. Conversely, in privately owned casetas, current regulations do permit its consumption, provided there is no additional specific regulation preventing it.
