Rental Air Conditioner Repair: Who Pays for the Breakdown?

As temperatures rise, the Urban Leases Law (LAU) and Civil Code define who must cover air conditioning repairs in rental properties.

With the arrival of hot weather, breakdowns in rental property air conditioning systems become a common concern. The Urban Leases Law (LAU) and the Civil Code define the responsibilities of landlords and tenants to prevent conflicts arising from these issues.
According to Article 21.1 of the LAU, the landlord is obligated to carry out necessary repairs to maintain the habitability of the property, provided the deterioration is not attributable to the tenant. If the air conditioner is part of the property's equipment and the breakdown is due to normal wear and tear or the passage of time, the landlord must cover the repair costs.
However, if the problem arises from improper use, negligence, or a direct action by the tenant, the latter must bear the cost, in accordance with Articles 1.563 and 1.564 of the Civil Code. The LAU also specifies that minor, everyday repairs, such as cleaning or changing filters, cleaning grilles, or replacing a remote control, are the tenant's responsibility.
In the event of a breakdown, the tenant must notify the landlord as soon as possible, as per Article 21.3 of the LAU. In urgent cases, where the breakdown causes significant discomfort or could lead to greater damage, the tenant may proceed with the repair and subsequently claim the cost from the landlord, always maintaining clear communication to prevent conflicts.
