The board of Madrid judges has expressed support for magistrate Juan Carlos Peinado, who has faced "professional and personal attacks" and a "permanent questioning of his jurisdictional work and judicial independence" in connection with the investigation against the wife of the Government president, Begoña Gómez. This stance differs from that of the General Council of the Judiciary (CGPJ), which merely called for respect for the separation of powers.
The Madrid magistrates have directly pointed to the Minister of the Presidency, Relations with the Cortes, and Justice, Félix Bolaños, accusing him of "undermining citizens' trust in judges" by failing to respect judicial independence and the separation of powers. In a brief statement, the judges rejected the "disqualifications" from members of the Executive against the head of Madrid's judicial court number 41.
We will continue to perform our constitutional function, as members of the Judiciary, and public service to citizens.
The origin of these criticisms lies in magistrate Peinado's recent order, which concludes the investigation against Pedro Sánchez's wife and brings her closer to trial for four alleged crimes: influence peddling, business corruption, embezzlement of public funds, and misappropriation. The crime of professional intrusion, related to the management of software for the Competitive Social Transformation chair at the Complutense University of Madrid, was withdrawn to send the case to a jury trial.
The resolution was made public during an official trip by the Government president to China, which his wife attended. Despite criticism from judicial associations and the opposition, who consider his words an attack on the separation of powers, Minister Bolaños defended his comments, citing freedom of expression. He stated that his opinion is "widely shared by a very large part of society and also by the judicial career" and expressed his "absolute confidence" that a higher court could overturn Peinado's decisions if they are contrary to the legal system.
