The judicial proceedings related to the death of Ana Buza, a 19-year-old who passed away in 2019, have faced an unexpected postponement. The oral hearing, initially scheduled to commence on May 4 at the Audiencia de Sevilla, will not proceed as planned. The primary reason is the call for the Andalusian Parliament elections, set for May 17.
Judge Ángeles Sáez, who presides over the Jury Court in this case and works in the Seventh Section of the Provincial Court, was appointed on March 25 by the Permanent Commission of the General Council of the Judiciary (CGPJ) as president of the Provincial Electoral Board of Seville. This position, which requires exclusive dedication, prevents her participation in trials until after the electoral process, as detailed in the Official Gazette of the Province (BOP) on March 27.
The presidents of the Provincial Electoral Boards shall be exclusively dedicated to the functions of their respective electoral boards from the call for an electoral process until the proclamation of elected officials.
A decree issued on March 30 by the judge herself confirms the suspension, nullifying the May date. The decision is based on article 10.3 of the Organic Law of the General Electoral Regime. The new provisional date for the trial's commencement has been set for September 4, with an estimated duration of nine sessions concluding on September 18.
This postponement extends the resolution of a complex case that, more than six years later, continues to generate controversy. The defense of the sole accused, Ana's then-boyfriend, maintains that she committed suicide by jumping from the moving vehicle. Conversely, Ana's family argues that she was run over by him after getting out of the car following an argument, classifying it as murder.
The Prosecutor's Office, based on reports from the Guardia Civil and experts, rules out both suicide and murder. Their theory is that the boyfriend was driving at an excessive speed in the section where the incident occurred, classifying the events as negligent homicide and requesting three years in prison. The provisional indictment details that Rafael V.P., 25 years old at the time of the events, and Ana, 19, had an argument in the early hours of September 6-7, 2019. The Prosecutor's Office indicates that, at kilometer 511 of the A-4, where the speed limit is 80 km/h, the accused was driving at 117 km/h, which caused Ana to fall from the moving vehicle and suffer fatal injuries.
