The events, dating back to July 2019, involve two individuals who, according to the provisional conclusions of the Public Prosecutor's Office, took advantage of the victim's vulnerability, described as an orphan with a mild to moderate intellectual disability, illiterate, and emotionally immature.
The accused offered the man work in the agricultural sector, specifically in potato harvesting on farms in the region. From the outset, they withheld his personal documentation and, despite full days of work, never paid him any wages. The justification given was a supposed debt of 20,000 euros that the man had to settle before he could leave.
During this period, the victim lived with the accused. Initially, he was provided with a sofa in a hallway, but eventually ended up sleeping on the rooftop of the dwelling, on a mattress on the ground and under a tent. Furthermore, one of the accused used the man's personal documentation to register him as a self-employed worker with the General Social Security Treasury (TGSS) for agricultural support activities, without the victim's knowledge. This action aimed to give an appearance of regularity to temporary contracts in the agricultural sector.
“"On several occasions, the victim asked his captors to let him return to his place of origin, but they always refused."
Finally, the man managed to escape from the house under the pretext of taking out the trash. He was later found disoriented and showing signs of malnutrition at a roadside inn near Alcalá de Guadaíra. During a search of the accused's home, personal documentation belonging to the victim, employment documents of several foreign citizens, notebooks with annotations, and 745 euros from the illicit activity were found.
The Prosecutor's Office considers the facts to constitute a crime of human trafficking for labor exploitation, as well as a continuous crime of falsification of official documents. The trial is scheduled for April 28 at the First Section of the Provincial Court of Seville.
