The Provincial Court of Málaga has ruled for the issuance of an international search and arrest warrant against former Málaga CF executives and their three children, who are linked to a judicial case. This decision, initially reported by Radio Marca Málaga and confirmed by sources from the Association of Small Shareholders of Málaga CF, aims to ensure their appearance before justice.
The resolution from the Provincial Court, second section, partially revokes a previous order and mandates the issuance of both national and international arrest warrants. This measure is justified by the defense strategy of the accused, who, according to the court, have used their right to defense and their residence abroad for dilatory purposes and to obstruct the legal proceedings.
“"They have been using their right to defense and their situation of residence abroad for dilatory purposes and to hinder the progress of the procedure, maintaining an attitude of clear negligence in asserting their right to defense."
Judge María de los Ángeles Ruiz González must now agree to issue this order. The decision is also based on the current lack of legal representation for the accused, who have resigned their previous lawyers without appointing new ones, and on the failure of international judicial cooperation with Qatar to locate them.
The Prosecutor's Office's request to issue a national and international arrest warrant, using the OED form for international requests, remains in effect while a rogatory commission is processed. The uncertainty regarding the whereabouts of the accused and the risk that the slowness of international judicial procedures could prevent securing their physical presence make this measure necessary for the opening of the oral trial in this complex case, which has kept Málaga CF under judicial supervision for over six years.
