The Supreme Court has dismissed the cassation appeal filed by the defendant, thus making the seven-year prison sentence imposed by the Provincial Court of Malaga for attempted homicide final. The events occurred in the early hours of September 26, 2023.
According to the ruling, the aggressor approached the victim, who was sitting on a bench on the promenade, and after saying "I wanted to see you," stabbed him twice in the chest. The victim was admitted to the ICU in serious condition, where he remained in an induced coma and hospitalized for 11 days.
The judicial ruling details that the wounds, due to their location and depth, compromised the life of the stabbed man, who suffered lung injuries and hemorrhages, requiring several surgical interventions.

In addition to the prison sentence, the convicted man must compensate the victim with 26,000 euros for the injuries and after-effects. He has also been prohibited from approaching or communicating with the injured party for eight years.
The defendant argued in his appeal that there was insufficient evidence to identify him and that the events should be classified as a crime of injury. However, the Supreme Court has upheld the conclusions of the lower courts, highlighting that the victim identified the aggressor, whom he knew previously, and considering the intent to kill to be proven.
