The Eighth Section of the Provincial Court of Malaga has ratified the dismissal of the judicial case opened against the councilor of the City Council of Malaga, Jacobo Florido, for an alleged crime of malicious treatment. The decision dismisses the appeal filed by the councilor's ex-partner against the ruling of the Court of Violence Against Women number 1 of Malaga, which had already ordered the provisional shelving of the proceedings.
The judicial resolution emphasizes that all investigative proceedings carried out over several years were analyzed in detail, concluding that the crimes reported by the appellant could not be justified. The expert reports from the UVIG, including a forensic expert, a psychologist, and a social worker, concur on the absence of indicators of mistreatment, which is particularly relevant in cases of gender and domestic violence.
Regarding the minors' statements, the court considers that the conclusions drawn by the investigating judge are not arbitrary or lacking in motivation. The investigation has been exhausted, making further investigative actions impossible.
“"Justice has proven me right. My innocence and the falsity of the accusations made against me, with evident bad faith, by my ex-wife have been demonstrated. Preliminary proceedings for false accusation will be initiated against her at the Public Prosecutor's Office's indication."
Councilor Jacobo Florido himself commented on the resolution on social media, calling it the end of a 'nightmare' lasting over two years. He expressed his desire to turn the page without resentment but indicated his intention to seek explanations from the Government's sub-delegate in Malaga, Javier Salas (PSOE), regarding alleged leaks of sensitive information from the Viogen system, which Florido claims were used to politically damage him.
Florido clarified that the initial restraining order was reciprocal, also affecting his ex-partner, a detail he believes was deliberately omitted from the information that circulated. He criticized the potential breach of confidentiality of restricted Ministry of the Interior information intended to attack him and called for accountability.
