The motion to remove the item from the agenda passed with seven votes in favor, against five from the government team that advocated for proceeding with the vote. This decision keeps the building permit, granted 23 years ago for the property located in the Cabo de Gata-Níjar Natural Park, in effect for the time being.
During the debate, the groups requesting the postponement argued the need for more information regarding the potential economic and legal repercussions for the municipality. They highlighted the lack of a detailed financial report assessing the budgetary impact of a potential license annulment, as well as the responsibilities that could arise for other administrations.
Meanwhile, the municipal government team defended the need to comply with the ruling of the High Court of Justice of Andalusia from July 2021, which urged an official review of the file. The Consultative Council of Andalusia had already issued a favorable opinion on the resolution, considering that the license could be null and void as it was granted on protected land and within the coastal protection zone.
The future of the building, which has been stalled since 2006 when it was 95% complete, remains pending this municipal procedure. The resolution is a necessary step for the Regional Government of Andalusia and the Central Government to move forward with the joint commission in charge of the environmental restoration of the site.
