Following a new telematic meeting of the joint commission between both administrations, the only conclusion reached is to request the TSJA to act to declare the building permit null and void. This decision comes after the town council of Carboneras failed to approve such nullification last week.
The legal services of the Junta and the State Attorney's Office are already working on the request to the high court. However, the TSJA has repeatedly expressed its reluctance to act ex officio, which could complicate the process. The Junta seems to have accepted the need to "remove the City Council" from this process, a stance that has evolved in recent weeks.
For its part, the Ministry for Ecological Transition (Miteco) recalled that the submission of the minutes from the Carboneras council meeting to the TSJA has already been completed. The request for the Consistory to hold a new session within 72 hours appears difficult to fulfill, given the situation of the PSOE councilors and the non-affiliated members.
Where there has been no consensus is on the expropriation route. The Miteco maintains that this option remains open, despite the enormous differences in valuations: the Government offers 16,500 euros, while the development company claims 44.5 million euros. This disparity is one of the main obstacles that the Carboneras Consistory uses to delay the nullification of the permit.
The immediate future of the hotel, whose construction began more than two decades ago, remains uncertain. The next steps involve the City Council's request for permit nullification, a process that will likely be appealed in the courts, thus guaranteeing further delays.
Both administrations also agreed to maintain "fluid dialogue" and convene a new meeting of the joint commission once the hotel's license is annulled, an encounter expected to have similar success to previous ones.
