The Civil and Criminal Chamber of the High Court of Justice of Andalusia (TSJA) has upheld the sentence issued by the Provincial Court of Huelva, which condemned three individuals from the same family to three years and six months in prison for a public health offense. In addition to the prison term, each convicted person must pay a fine of 12,000 euros.
The events date back to September and October 2023, when the family home of the accused in the capital of Huelva was identified as a drug sales point. Agents from the National Police established a surveillance operation after receiving reports indicating the residence as a hub for selling narcotics, primarily cocaine.
During the search conducted on October 17, 2023, police found a significant variety of substances distributed throughout the rooms. Among the seized items were 63 grams of cocaine with 85.64% purity, dozens of pre-packaged containers for sale, small quantities of hashish, cannabis resin, and methadone tablets. Agents also confiscated a precision scale, tools for drug manipulation, bladed weapons, notes, and 2,360 euros in cash, all proceeds from the illicit activity. The total street value of the drugs was estimated at 5,240 euros.
The TSJA dismissed the family's appeal, which argued that mere cohabitation did not imply participation in the crime. However, the court found that “additional circumstances” went beyond simple shared residence, demonstrating the accused's involvement. Police agents observed the accused recruiting clients, giving them instructions from the window or doorway on whether they could enter the dwelling to purchase the “packets,” and conducting surveillance to detect police presence, even warning buyers to facilitate their safe exit from the property.
