After more than a year of legal deadlock, the Córdoba City Council has given the green light to the regulation that will once again allow retirement bonuses to be paid to its employees. The new rule, initially approved in the April plenary session and later amended, sets a financial compensation of 12,350 euros for those who retire at the legal age and up to 19,271.5 euros for those who opt to retire two years earlier.
This measure provides legal coverage for an incentive that had been suspended since December 14, 2023, with the entry into force of the Law 5/2023 on Public Function of Andalusia. Since then, nearly 200 retired municipal employees had not been able to receive these bonuses due to the lack of a specific regulation to develop the regional norm. The issue arose from rulings by the Supreme Court indicating that these bonuses could only be paid if legally provided for, prompting the administration to seek an adequate regulatory framework.
The approval of the Andalusian Public Function Law, in its Article 70, has been key, as it expressly recognizes the 'retirement bonus' for civil servants, deferring its development to subsequent regulatory provisions, such as the one now approved by the Cordoban council.
The regulation establishes three distinct financial tiers. The standard amount will be 12,350 euros for retirement at the legal age. For early retirement, the amounts increase: 19,271.5 euros for those retiring two years early and 9,635.75 euros for those retiring one year early. Furthermore, the amounts will be reviewed annually according to the CPI if it is positive, ensuring the maintenance of purchasing power.
To access the so-called 'Extraordinary Retirement Bonus', civil servants must demonstrate at least 20 years of uninterrupted service with the Córdoba City Council. The text also includes a proportional formula for those who do not meet this seniority, as well as for employees with a minimum of 15 years of service. The regulation clarifies that those who voluntarily extend their working life beyond the legal age will not lose their right to this compensation.
Access to the higher bonuses for early retirement is subject to strict conditions: the worker must have contributed enough time to be eligible for a pension, and their regulatory base must be below 100%. Additionally, early retirement recognized by the Social Security is required, with a maximum one-month period to apply from the corresponding age, subject to a penalty if submitted late.
The bonus will be incompatible with any other retirement compensation paid by other public administrations, with one express exception: the extraordinary retirement bonus may be combined with the early retirement incentive provided for in the labor regulations of the Córdoba City Council itself. The regulation will have retroactive effects from December 14, 2023.
