The legal dispute between the PSOE of Algeciras and the popular mayor, José Ignacio Landaluce, has escalated, now involving the Vice President of the Government, María Jesús Montero. The socialist politician is required to appear before Justice for accusations of «slander and libel» made against the mayor of Algeciras, whom she publicly accused of committing «gender violence» against female colleagues in the council.
The origin of this judicial confrontation dates back to last year, when socialist councilor Rocío Arrabal reported alleged harassment by the mayor. Landaluce consistently denied the allegations, and after an investigation, the Supreme Court Prosecutor's Office dismissed the complaint filed by the PSOE in January of this year, ruling out crimes such as embezzlement, influence peddling, harassment, or sexual abuse.
There are currently no active investigation proceedings.
Following this dismissal, Landaluce announced a lawsuit against Rocío Arrabal for an unfounded complaint, although this action was rejected by the High Court of Justice of Andalucía (TSJA). The Civil and Criminal Chamber of the TSJA confirmed the dismissal of the slander lawsuit, arguing that political debate should not be resolved in the courts except in exceptional cases.
Now, attention turns to María Jesús Montero. A Madrid court has summoned her to a conciliation hearing on June 4, at Landaluce's request, before deciding whether to file a formal lawsuit. The conciliation demand is based on statements made by Montero on January 13, in which, according to the mayor's lawyer, she «falsely imputed that he had been convicted, reported, and investigated for a crime of gender violence».
Landaluce's lawyer has detailed that the lawsuit demands a public retraction from the former Minister of Finance, a cessation of her statements, and the payment of 200,000 euros in compensation. The lawsuit also includes subsequent statements by Montero where, according to the claim, she «again referred to that complaint deliberately concealing that it had been filed by PSOE colleagues reproducing publications by 'Alvise' Pérez» and that it had already been dismissed by the Supreme Court Prosecutor's Office on January 9.
