The Ministry of Health and Consumer Affairs of the Junta de Andalucía has imposed a 45,000 euro fine on the Cines Yelmo chain at its Algeciras location. This resolution states that preventing spectators from entering with food and beverages purchased outside their premises is an abusive practice and a serious violation of consumer regulations.
The administrative decision is based on the Andalusian Law for the Defense and Protection of Consumers and Users. According to records from the General Directorate of Consumer Affairs, the primary activity of cinemas is film exhibition. Therefore, conditioning this main service on the exclusive purchase of products at their bar, when consumption is allowed inside the screening room, is considered an unfair practice.
“"By allowing consumption inside, the company cannot force purchases to be made exclusively at its establishment. This technical resolution clarifies that the right of admission cannot protect the imposition of unsolicited services on the customer."
This sanction sets an important precedent in the province, confirming that signs prohibiting external food are legally invalid if the venue allows product consumption inside. The measure aims to protect consumers from disproportionate costs for basic products and ensure their freedom of choice.
Authorities have been clear that a cinema's bar service is ancillary. The law prohibits conditioning the provision of a main service on the acquisition of a complementary one. Should entry with food be denied, users have the right to request an official complaint form, which must be submitted to consumer authorities to initiate the corresponding proceedings.
