The proposal, announced in Cádiz, arises in a context of solidarity with two workers who remain on a crane at the Navantia facilities in San Fernando. These workers believe their exclusion from the auxiliary metal industry is due to their inclusion on alleged blacklists.
“"There cannot be blacklists in companies concerning people who are union-committed. This must be eradicated; it goes against the fundamental right to union freedom and against democracy."
The initiative seeks to amend the Workers' Statute, specifically Article 4, to prohibit persecution for union reasons and defend employees' right to exercise a function recognized as fundamental in the Constitution. This would outlaw blacklists used to discriminate against union affiliation and commitment.
Additionally, the proposal suggests an amendment to the Law on Infractions and Sanctions in the Social Order. Article 8 would establish as a very serious infraction the creation or discrimination through lists containing personal data on workers' union affiliation, considering that these practices are used to discriminate in access to the labor market.
