The law firm representing the association of victims of the Adamuz derailment has confirmed that they are studying the feasibility of filing a claim for patrimonial responsibility against the Railway Infrastructure Administrator (Adif). This decision is based on the Civil Guard report, which identifies a broken rail as the main cause of the accident that resulted in 46 fatalities in the Cordovan town.
The Civil Guard report, sent to the judge in Montoro investigating the case, concludes that no anomalies were found in the trains involved, strengthening the hypothesis of infrastructure failure as the origin of the event. A spokesperson for the victims' association has indicated that this claim is parallel to the ongoing judicial process and will be finalized once the investigation progresses and responsibilities are confirmed.
“"After reading the report, we are analyzing the possible patrimonial responsibility that, if confirmed in subsequent reports, could be demanded from the entity responsible for infrastructure maintenance, in this case Adif."
Furthermore, the victims' lawyers have appealed the judge's request to unify the popular accusations, arguing that this measure could compromise their defense strategy and violate the rights of those affected. They have cited precedents where the accumulation of accusations has been denied in cases with a high number of involved parties.
The investigation is in an initial phase, and the Railway Accident Investigation Commission (CIAF) has not yet begun analyzing the elements recovered from the accident site. Additionally, the appointment of judicial experts has been appealed by one of the victims' families, due to potential conflicts of interest with companies that carried out works on the affected section.
