The Audiencia de Almería has issued a sentence against a woman for a public health offense, after she was intercepted with illicit substances at the prison. The incident occurred on July 18, 2024, when the accused visited the penitentiary center for a face-to-face meeting with an inmate from module 18.
During the security check at the entrance, the metal detector arch triggered an alarm. Following a search by female officers, 8.18 grams of cocaine were found hidden in her shoe. Despite her initial denial, a second alarm led to a more thorough search, revealing a package containing 187.83 grams of cannabis resin, two mobile phones, and three SIM cards concealed in her underwear.
The street value of the seized drugs has been estimated at 1,749.65 euros. The court rejected the defense's claim of an attempted crime, ruling that the accused possessed and transported the drugs with the intention of surreptitiously delivering them to an inmate.
However, the Second Section did not apply the aggravated subtype for committing the act in a penitentiary center. The magistrates concluded that, as she was discovered during the preliminary control, “there was no possibility for the drugs to reach the inmates.” The ruling also imposes a special disqualification from exercising the right to passive suffrage for the duration of the sentence and the payment of legal costs. The judgment is subject to an appeal before the Criminal Chamber of the Superior Court of Justice (TSJA).
