The Public Prosecutor's Office is seeking an eight-year prison sentence for the accused for continuous crimes of threats and slander, in addition to a crime of obstruction of justice. This request is accompanied by a fine of 38 months, with a daily fee of ten euros, for continuous crimes of insults and breach of sentence with the aggravating circumstance of recidivism.
The Prosecution has also requested accessory measures, such as restraining orders and communication bans regarding the victims, and a prohibition from publishing content related to the affected parties on TikTok for 15 years. In the civil sphere, compensation of approximately 30,000 euros is sought for the victims for the damages caused.
The accused, who has four previous convictions and several ongoing judicial proceedings, published approximately 120 videos between October 18, 2024, and March 7, 2025. These self-produced contents included threatening expressions, insults, and serious accusations against judicial authorities, Civil Guard agents from Garrucha and Vera, and a woman with whom he had an sporadic romantic relationship.
The Prosecution argues that the defendant used the social network after being released from provisional prison in one of his cases, with the intention of intimidating those involved in the proceedings and damaging their reputation, being aware that his publications would reach the affected parties. In the videos, the accused directly named judges and prosecutors, accusing them of issuing rulings contrary to legal order, and even displayed a geolocation bracelet while criticizing his judicial situation.
The tone of the publications escalated, eventually including explicit threats of revenge and even of attacking a judge. The investigation is based on a police report from the Judicial Police of the Civil Guard of Garrucha, which includes the viewing and full transcription of the TikTok videos, considered key to the prosecution.
Lawyer Miguel Martínez, representing the affected woman, is seeking sentences totaling several years in prison for crimes such as threats, slander, assault on authority, obstruction of justice, breach of sentence, and a crime against moral integrity, in addition to 70,000 euros in civil liability for moral damages. The defense, for its part, requests a full acquittal, arguing that the facts do not constitute a crime and questioning the authenticity of the videos.
